Terms and Conditions

Welcome to the Geoship Reservation Referral Rewards Program (the “Referral Program”)! The duration of the Referral Program is from October 2024 and beyond, unless terminated or extended by Geoship at its sole discretion (the “Program Duration”).

These terms and conditions (“Terms”) are entered into by Geoship S.P.C. (“we,” “us,” and “our”) and the Referrer (“you” or “your”) regarding your participation in our Referral Program as displayed on our website https://www.geoship.is/.  

By participating, you confirm that: (a) you have the legal authority to enter into the Terms and you are 18 years or older; (b) you have read, understood, and agreed to the Terms; (c) you are a resident of the United States, and (d) the Terms form a legally binding agreement between you and us. Your participation is also subject to our Terms & Conditions, and Privacy Policy. 

We may update, modify, or discontinue the Referral Program, or change the Terms at any time, at our sole discretion, and without prior notice. By continuing to participate in the Referral Program after any updates or changes to the Terms, you confirm your agreement to be bound by the revised Terms.

1. How The Referral Program Works

The Referral Program is designed to reward individuals who refer new customers to Geoship. Successful referrals can lead to various rewards, including discounts, experiences, and even free Geoship domes, based on the number of successful referrals made, and for specific reward tiers, based on referred individuals’ binding delivery orders or dome deliveries. A referral is considered successful when a referred individual submits their reservation deposit for a Geoship dome during the Program Duration and such individual does not request a refund or cancel the reservation. Referred individuals must be new customers who have not previously placed an order or “reservation” with Geoship and who have not been referred by others to place an order or “reservation” with Geoship.

2. Rewards

The Referral Program offers a variety of rewards to you based on the number of successful referrals, binding delivery orders, or dome deliveries. The reward tiers are as follows. The Referral Program follows a milestone-based structure. Participants unlock specific rewards as they reach set milestones. You cannot mix and match rewards or save up referrals for multiple rewards. For example, once you hit 40 referrals, you automatically unlock a 5% discount and you cannot split referrals—such as using 30 referrals to claim a reward at the 30-referral tier and the remaining 10 referrals to claim a reward at the 1-referral tier. Each reward tier is available and only available when the required number of referrals for that specific milestone is achieved. If you achieve a higher-tier reward, lower-tier rewards are no longer applicable.

• 1 referral: Raffle ticket to win a free Geoship dome.

• 20 referrals: Dinner with our CEO (with timing mutually agreed upon) + VIP Geoship Tour (with timing mutually agreed upon). Please note that travel expenses will not be covered as part of this reward. Dinner location will be determined at our discretion. 

• 30 referrals: Spend a night in a Geoship dome (location to be determined at our discretion, with timing mutually agreed upon). Please note that travel expenses will not be covered as part of this reward.

• 40 referrals: 5% discount on your own purchase of one Geoship dome.

• 50 referrals: 10% discount on your own purchase of one Geoship dome.

• 60 referrals: Your own reservation will be bumped to the front of the line within your fulfillment wave.

 

• Every 70 qualifying binding delivery orders from the referred individuals with respect to your successful referrals: 30% discount on your own purchase of one Geoship dome. A binding delivery order is disqualified if such order is canceled, voided, fraudulent, revoked, duplicate, is not paid for otherwise deemed invalid, or if it fails to result in the delivery of Geoship domes to the referred individuals for any reason, or if the delivery is canceled, returned or otherwise not accepted by the purchaser.

• Every 80 qualifying deliveries to the referred individuals with respect to your successful referrals: Free Geoship dome for you + a Geoship dome donated to someone in need. A delivery is disqualified if the delivery is canceled, returned or otherwise not accepted by the purchaser, or if the underlying domes are not paid for in full. If you are eligible for this reward, you may nominate an individual you believe qualifies as someone in need. However, we will evaluate and approve the nomination to ensure the individual meets the established criteria. If you do not nominate someone when you redeem this reward, we will select a suitable recipient who meets the criteria and make the donation on your behalf.

You are solely responsible for any tax liabilities associated with the rewards earned through this Referral Program.

We reserve the right to substitute any reward with another of equal or greater value at our sole discretion, in the event that the original reward becomes unavailable.

3. Issuing Of Rewards

Rewards will be issued once the specified milestones in Section 2 are met and either you contact us to redeem your rewards or we reach out to you to facilitate redemption. Rewards for dome discounts will be applied when you place your final Geoship order. Physical rewards, such as VIP tours, will be scheduled with you once the corresponding referral milestone is achieved and either you contact us to redeem your rewards or we reach out to you to facilitate redemption. Rewards are subject to validation and may take up to 30 days for processing after the successful referral action is verified. Referrals will be tracked using unique referral codes/links provided to participants. You must ensure that the referred individual uses such code links for your referral to be eligible for a reward.

4. Privacy

All personal information collected and processed as part of this Referral Program will be used in accordance with Geoship’s Privacy Policy. Under applicable laws and regulations, Geoship is responsible for collecting and processing of such personal information.

As a referrer, you agree to respect the privacy rights of the individuals you invite to the Referral Program and direct to our website. You must inform them of the applicable terms and conditions, as well as our privacy policy, before they participate in the Referral Program and provide any personal information.

5. Completed Referrals and Limit

5.1 A Completed Referral is when you refer this Referral Program to one of your contacts. Subsequently, that contact will place a reservation with a deposit which is not canceled or disputed.

5.2 All referred individuals must be new and first-time customers. Existing customers cannot participate in and benefit from the Referral Program. Referrals are attributed on a “first come, first serve” basis. Only the first individual to refer a new customer will be eligible to receive a reward for that referral.

5.3 You represent all personal information about you is 100% correct and up to date. We may monitor your use of the Referral Program or request your ID to verify your identity before issuing rewards.

5.4 You must contact us no later than 90 days after the end of this Referral Program to redeem your rewards. Rewards that are not redeemed before the deadline will be forfeited. Unredeemed rewards will expire and cannot be reinstated.

6. Restrictions

6.1 This Program cannot be combined with other Geoship referral programs, discounts, promotions, vouchers, benefits, or incentives, unless expressly allowed in the terms and conditions in the other programs.

6.2 You must comply with all applicable laws and regulations and refrain from violating any third-party rights. For example, you must not use referral methods that are bothersome to the referred individuals including spamming or mass messaging or emailing that in violation of anti-Spam laws. You should not violate any of our or third parties’ copyright, trademark, or other proprietary and intellectual property rights.

6.3 You must not publish our Referral Program on any sites or platforms that contain any offensive, abusive, harassing, or defamatory content, or any adult content, alcohol, tobacco, gambling, games and online casinos, political content, or any form of illegal activities.

6.4 You must only use our Referral Program for personal use and refrain from its use for commercial purposes.

6.5 If you are a current or former employee, contractor, or affiliate of our company or if you are a family member of the foregoing persons, we may restrict your participation in the Referral Program, and we may restrict or cancel your participation with immediate effect. Please contact us first to verify your eligibility before you participate in this Referral Program otherwise you will not be considered as eligible.

6.6 If you use the Referral Program in breach of the Terms or applicable laws, we may suspend your use of the Referral Program.

6.7 All rewards earned through the Referral Program and eligibility for the rewards are non-transferable and may only be redeemed by the individual who earned them. Rewards cannot be assigned, gifted, or transferred to another person or entity under any circumstances, and any attempt to do so will result in the forfeiture of the rewards or eligibility for the rewards.

6.8 Any fraudulent activity, abuse of the Referral Program, or attempts to manipulate the referral process will result in immediate disqualification from the Referral Program and forfeiture of all rewards.

6.9 By participating in this Referral Program, you agree to receive communications related to the Referral Program. You may opt-out of these communications at any time.

6.10 We reserve the right to terminate your participation in the Referral Program immediately and all of your rewards will be forfeited if we determine that you have engaged in any form of misconduct, including misrepresentation or misuse of the program.

6.11 We reserve the right to audit referral activities to ensure compliance with program terms. Any fraudulent or suspicious activity may result in disqualification and forfeiture of rewards.

 

7. Term and Termination

The Terms will continue to apply as long as you use the Referral Program, provided that we reserve the right to:

7.1 terminate the Terms or the Referral Program at any time for any reason and without notice, including your participation or the availability of its benefits;

7.2 suspend your access to the Referral Program at any time, including in the event of your actual or suspected unauthorized use of the Referral Program, non-compliance with the Terms, or if we notice any activity that we reasonably believe fraudulent, improper, or unlawful, where we may cancel the distribution of any rewards; 

7.3 review and investigate all referral activities and to suspend accounts or modify referrals as deemed fair and appropriate

Any referral made before the end of the Referral Program can still participate. Referrals made after the program’s termination will not be eligible for rewards. If we suspend your access to the Referral Program, you agree that we shall have no liability or responsibility to you. Sections of the Terms, that, either expressly or by nature, must remain in effect even after termination of the Terms, shall survive termination.

 

8. Exclusive Relationship

8.1 You understand and agree that you are only a potential user of our services and/or products and you must refrain from implying of any other affiliation or legal relationship with us.

8.2 You understand and agree that you are never authorized to legally bind our company.

8.3 By participating in the Referral Program, you must not represent yourself as a duplicate, agent, or intermediary of our company.

9. Amendments

We may amend the Terms of this Referral Program and any changes will be posted on our website. We may send out updates via email too. We may also introduce or adjust incentives, benefits, and programs, which will come with additional terms. We encourage you to check our website for updates, as your continued participation indicates your awareness and acceptance of any changes.

10. Disclaimer 

10.1 We offer our Referral Program and its rewards only on an “as is” and “as available” basis. We may remove, change, and update the Referral Program in our sole discretion. We never make and will never any promises or guarantees about the content and information of our Referral Program. We disclaim our responsibility for any information that is incorrect or has errors.

10.2 Our Referral Program is based on our best efforts. You acknowledge and agree that we can never guarantee any benefit or result from your participating in the Referral Program.

11. Indemnification

You will defend, indemnify, and hold harmless us, our affiliates, directors, officers and employees against all claims, damages, liabilities, losses, expenses, and costs (including reasonable attorney’s fees) to the extent arising out of or related to your participation in the Referral Program and your breach of any terms and conditions in these Terms.

12. Limitation of Liability

To the fullest extent allowed by applicable law, you expressly understand and agree that: 

12.1 we, our affiliates, officers, representatives, directors, agents and employees shall not be liable to you for any indirect, incidental, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, cost of procurement of substitute goods or services, or other intangible losses, arising out of the use or inability to use our websites, systems, services, products, or programs, third party resources, without regard to whether we have been made aware of the possibility of those damages;

12.2 In no event shall our maximum aggregate liability arising out of these Terms and the Referral Program exceed the greater of (1) $100 or (2) the Rewards received by you.

 

13. No Correspondence, Disputes, And Refunds

No correspondence will be entered into regarding the distribution of discounts, vouchers, incentives, prizes, awards, or other benefits. We shall never respond to any complaint or accept any dispute about the Referral Program, and the abovementioned benefits are provided “as is,” without any refund or exchange.

Rewards earned through this program have no cash value and cannot be redeemed for cash or other forms of compensation.

14. Notices.

15. Governing Law. 

All claims arising out of or relating to these Terms or the Referral Program will be governed by the laws of the State of Washington, without regard to conflicts of law rules.

In the event of any dispute, claim, or controversy arising out of or relating to this Referral Program, including the breach, termination, enforcement, interpretation, or validity thereof, the parties agree to resolve the matter exclusively through binding arbitration administered by JAMS in accordance with its arbitration rules. The arbitration will take place in Seattle, Washington, and the arbitrator's decision will be final and binding on both parties. The arbitrator shall have the authority to award any form of individual relief or remedy that would otherwise be available in court. Each party shall bear its own costs, except that the prevailing party may be awarded reasonable attorney’s fees and costs.

By participating in this Referral Program, you waive the right to bring any claims in court or to have disputes heard by a judge or jury.
